Annual update to list of Financial Services Providers under OTC derivatives regulatory regime

The following is issued on behalf of the Hong Kong Monetary Authority:
 
     The Hong Kong Monetary Authority (HKMA) and the Securities and Futures Commission (SFC) today (June 24) issued the joint consultation conclusions on the annual update to the list of Financial Services Providers (FSP List) (Note 1) under the over-the-counter (OTC) derivatives clearing regime.
      
     Having considered the market feedback, the HKMA and the SFC will proceed with the proposed changes to the FSP List as set out in the joint consultation paper (Note 2). The consultation conclusions paper and the updated FSP List can be downloaded from the websites of the HKMA and the SFC.
 
Note 1: The FSP List includes entities that meet the following two criteria:
(i) They belong to a group of companies appearing on the list of global systemically important banks published by the Financial Stability Board, or on the list of dealer groups which undertook to the OTC Derivatives Supervisors Group to work collaboratively with central counterparties, infrastructure providers and global supervisors to make structural improvements to the global OTC derivatives markets; and
(ii) They are members of the largest central counterparties offering clearing for interest rate swaps in the United States, Europe, Japan and Hong Kong.

Man sentenced for breaching compulsory quarantine order

     A 48-year-old man was sentenced to immediate imprisonment for six days by the Tuen Mun Magistrates' Courts today (June 24) for violating the Compulsory Quarantine of Certain Persons Arriving at Hong Kong Regulation (Cap. 599C).

     The man was earlier issued a compulsory quarantine order stating that he must conduct quarantine at home for 14 days. Before the expiry of the quarantine order, he left the place of quarantine on June 11, 2021, without reasonable excuse nor permission given by an authorised officer and was stopped by an immigration officer at the Shenzhen Bay Control Point. He was charged with two counts of contravening sections 8(1), 8(4) and 8(5) of the Regulation and was sentenced by the Tuen Mun Magistrates' Courts to immediate imprisonment for six days for each of the two charges, with the sentences to run concurrently.

     Breaching a quarantine order is a criminal offence and offenders are subject to a maximum fine of $25,000 and imprisonment for six months. A spokesman for the Department of Health said the sentence sends a clear message to the community that breaching a compulsory quarantine order is a criminal offence that the Government will not tolerate, and solemnly reminded the public to comply with the regulations. As of today, a total of 146 persons have been convicted by the courts for breaching compulsory quarantine orders and have received sentences including immediate imprisonment for up to 14 weeks or a fine of up to $15,000. The spokesman reiterated that resolute actions will be taken against anyone who has breached the relevant regulations.




Hospital Authority announces senior appointment (with photo)

The following is issued on behalf of the Hospital Authority:

     The Hospital Authority (HA) spokesperson announced the following senior appointment today (June 24):
 
     Dr Ian Cheung will be appointed as Hospital Chief Executive (HCE) of Yan Chai Hospital with effect from August 2, succeeding Dr Ching Wai-kuen, who has taken up the post of HCE of Cheshire Home, Chung Hom Kok, Ruttonjee & Tang Shiu Kin Hospitals and Tung Wah Eastern Hospital.
 
     Dr Cheung is a specialist in emergency medicine. He has worked in various departments in the HA Head Office since 2006. He was the Chief Manager (Clinical Effectiveness and Technology Management) prior to being appointed to his current post of Chief Manager (Cluster Performance) in 2016. Dr Cheung is a seasoned senior executive with solid management experience at the corporate level. He maintains and enhances cluster liaison and performance monitoring functions to support the strategic direction of the HA, such as driving the development of the Key Performance Indicator framework for service improvement and performance monitoring. He is also the overall person in charge to manage the demand surge in winter within the HA to alleviate the immense pressure on hospital staff while maintaining the standard of care in patient management.
 
     The HA Chairman, Mr Henry Fan, and the HA Chief Executive, Dr Tony Ko, congratulated Dr Cheung on his new appointment and wished him every success in taking up the new role.

Communications Authority press release

     This press release summarises the decisions of the Communications Authority (CA) following its 108th meeting held in June 2021:
 
Breach of licence condition by WarnerMedia Asia Pacific (HK) Limited (WMAP)

     The CA decided that WMAP, a non-domestic television programme service (non-domestic TV) licensee, has breached Condition 10.1 of its non-domestic TV licence by failing to seek the requisite approval of the CA prior to the implementation of a change to the line-up of programme channels during the period from December 16, 2020, to March 15, 2021. Taking into account the circumstances of the case as well as the nature, duration and severity of the breach, the CA decided that WMAP should be strongly advised to observe the relevant licence condition more closely.
 
Breach of licence condition by Phoenix Satellite Television Company Limited (Phoenix)

     The CA decided that Phoenix, a non-domestic TV licensee, has breached Condition 10.1 of its non-domestic TV licence by failing to seek the requisite approval of the CA prior to the implementation of the changes to the shareholding structure of Phoenix during the periods from July 18, 2018, to March 24, 2021, and from August 22, 2018, to March 24, 2021. Taking into account the circumstances of the case as well as the nature, duration and severity of the breach, the CA decided that Phoenix should be advised to observe the relevant licence condition more closely.
 
Broadcast complaint

     The CA considered a complaint case about the television advertisement for "JcoNAT Naturally-Existing Disinfectant" broadcast on the Jade Channel of Television Broadcasts Limited (TVB) in June 2020. The CA decided that TVB should be advised to observe more closely the relevant provision of the Generic Code of Practice on Television Advertising Standards.
